Employment Rights Act 2025

Practical readiness for employers.

Employment law is changing in stages. For employers, the important question is not simply what may change and when — it is whether your people practices are ready to support fair, consistent decisions.

A practical starting point

Where policy meets everyday practice.

For many organisations, the first risk is not a missing sentence in a handbook. It is the gap between written policy and day-to-day practice: how managers deal with absence, probation, performance, family leave, employee relations and workplace change.

Kindred HR (NW) Ltd helps SMEs and purpose-led organisations take a practical, proportionate approach to Employment Rights Act readiness. We focus on the areas that matter to your organisation, build a manageable plan and help your people managers apply it with confidence.

Employer roadmap

See the wider readiness picture.

The roadmap brings together the areas employers may need to monitor and the practical preparation that can support consistent people decisions.

Practical priorities

What employers should be thinking about now.

The best response is rarely to rewrite every document at once. A more useful starting point is to understand what already works, where your evidence is thin and where managers need clearer support.

01

Audit what you already have

Review the documents and processes that shape everyday employment decisions. This may include:

  • contracts of employment and offer documentation;
  • staff handbooks and key people policies;
  • absence, family leave and flexible-working processes;
  • probation, performance, capability and dismissal guidance;
  • grievance, disciplinary and whistleblowing procedures;
  • redundancy and organisational-change processes; and
  • payroll instructions, template letters, induction content and record-keeping.

The aim is not just to identify outdated wording. It is to see whether the way work is actually managed matches the standards set out on paper.

02

Strengthen manager confidence

Managers often make the decisions that carry the greatest employment risk. They need clear expectations, a consistent process and confidence about when to ask for HR support.

Practical manager support can cover:

  • setting expectations clearly during probation;
  • dealing with absence fairly and consistently;
  • recording conversations and decisions appropriately;
  • recognising when health, family leave, protected characteristics or other factors need careful consideration;
  • handling difficult conversations with professionalism and care; and
  • escalating concerns before they become more difficult to resolve.
03

Check whether your records tell the story

Good people practice is easier to evidence when the records are clear. We help organisations look at whether important decisions can be understood from the record: what happened, what support was offered, what the employee said and why the next step was taken.

04

Plan changes rather than react to them

Employment-rights changes can affect policy, payroll, manager training, workforce planning and internal communication. A short implementation register helps turn a complex programme into manageable actions.

For each relevant change, record:

  • the issue being monitored;
  • the document, process or team affected;
  • the accountable owner;
  • the action required;
  • the manager briefing or training needed; and
  • where completion evidence will be held.

Implementation framework

A practical first 90 days.

This is Kindred’s practical implementation framework, not a statutory commencement timeline.

1–30

Understand the starting point

Identify the documents, processes and decisions most likely to be affected. Prioritise high-frequency, high-consequence areas such as absence, probation, performance, family leave and employee relations.

31–60

Test manager practice

Talk through realistic scenarios with managers. Check that expectations are clear, support is recorded and there is a consistent route for seeking HR advice before a significant decision is made.

61–90

Improve consistency

Review a small sample of recent cases across teams. Look for practical learning: are similar issues being approached in similar ways, are decisions explained and is the relevant context being considered? Use the findings to refine guidance, templates and training.

Better decisions, made earlier

The value of being prepared.

Readiness is not about creating more paperwork. It is about helping people make better decisions, earlier — with clarity for managers, fairness for employees and confidence for the organisation.

If you are unsure where to begin, a focused readiness conversation can help you decide what matters most now and what can be planned for later.
